US Bank Deposits Unsafe Fraud Conversion Complaint

Complaint regarding US Bank unsafe and unsound banking practices.

On May 31, 2002, US Bank in Nashville, Tennessee allowed a $61,000 (sixty one thousand dollars) theft from a senior citizen and family's US Bank account.

US Bank advertises "Five Star Service Guaranteed" but that is not what this senior citizen received. US Bank turned their back on their customers then refused to correct their mistake or hold the other party accountable.

Members of congress were contacted with complaints of conversion but none would help. We were told that there was nothing they could do
about it. Everyone said that the complaint must go to the OCC.

A complaint was filed to the Office of the Comptroller of the Currency (OCC) who regulates national banks. A vice president of US Bank gave inaccurate statements to this government agency in what we believe was an attempt to cover up gross negligence. Even though it is a federal offense to lie in response to a government inquiry, the OCC still refused to do anything to US Bank.

The OCC informed that there are no federal laws protecting the depositors. FDIC insured is only if the bank fails. Our complaint was closed in total disregard. In other words, a national bank can steal or allow someone to steal your money and there is nothing the federal regulators can or will do about it.

So, a lawsuit has been filed in Davidson County Circuit Court against US Bank. In response, US Bank has given false statements to the court still pretending they did nothing wrong. Apparently, US Bank believes that it is acceptable to give away $61,000 of their customer's money.

Our deposits were not safe in a national bank called US Bank. Since it happened to us, we believe that it could happen to anyone.

We don't have that bank out here in the West.......

Are there a lot of branches of this bank where you are from? You don't have to tell me where you are,I'm just curious about the size of the institution. I've never heard of it before. Keep us updated on your legal doings. We may have other victims that have been silent and seeing this, may come forward. That would surely help your case if there are others!

This complaint about U S Bank doesn't surprise me, I'm from Nashville area and have never seen such gross negligence by bank tellers in my life until I moved here. My hubby was in the military for 21 yrs, so I've lived everywhere in that time, and I must say, it bothers me greatly that one can go to the bank, cash a two party check, and not be asked for any I.D.---no proof of who you are. I took my son to cash his paycheck one day on the way to pick up his son, and he handed the teller his check, and she gave him the money, no I.D., nothing. So, people being taken for their life savings is not a surprise down here. It's probably a regular occurence. We have changed banks 3 times in 8 years for this very reason, and haven't found one yet, that checks I.D.

We've got US Banks here in Missouri. My brother in law and his wife have had nothing but problems from them. They even withdrew almost $200.00 out of their account to pay MY satelite bill then refused to refund the money they had taken for service charges because of bounced checks that they had due to this unauthorized charge. So I called up Dish and asked them why in the heck they would bill my brother in laws account and they said that was the card they had on file....go figure. That's only one of the problems that they have had with US Bank. I told them to change banks, but as of yet, they haven't.

Here is an article that I located regarding National Banks.

Stateline.org

Banking Rule Incites Ire

http://www.stateline.org/stateline/?pa=story&sa=showStoryInfo&print=1&id=364165

I can tell you that we filed complaints with The State Banking Authorities, Consumer Protection Agencies and the Better Business Bureau of Middle Tennessee but they would not hear the complaint.  Everyone said that the complaint must go to the OCC who regulates national banks.

We filed our complaint with the OCC but even they rejected us.

U.S. Bank N.A. allowed a $61,000 theft conversion from a senior citizen and family's US Bank account then lied to cover it up.

We no longer believe that your money is safe in a national bank.

Here are two more articles that I located regarding the OCC and National Banks such as US Bank.

http://www.commondreams.org/views03/1011-07.htm

http://www.stopatmfees.com/toppage3.htm

"OCC is the only commercial bank regulator dependent solely on funds provided by the very banks they regulate...As a result, OCC likes to keep its bank constituency happy. It doesn't want big national banks-which pay the freight-to get any notions about switching to state charters which might cause a precipitous decline in assessment income for OCC.  And it is no secret that the national banks like the idea that OCC is willing to fight their battles against state consumer laws."

No wonder we were totally blown off! It seems to me that the OCC has been bought and paid for by the banks they regulate. National Banks such as US Bank appear to be above the law.

And don't bother with the Better Business Bureau either.  I believe that they too are paid by donations from their 'Members'.  To date or at least the last time I printed it out, the BBB website states that US Bank in Nashville, Tennessee had ONE complaint in a three year reporting period and claims it was resolved.  This is FALSE ADVERTISING! Not only did I file a complaint against US Bank, our complaint remains UNRESOLVED and we have filed a lawsuit against US Bank.  It appears to me that the BBB is doing exactly what they claim they help others resolve.

Thank you Justice Junction for printing my complaint.

I believe US Bank's headquarters is here in Owensboro, KY.  In fact just down the road from me.  There are numberous complaint from people here as well.  You can check out your bank and the number of BBB complaints at www.bbb.com.  Click on Business and then search for US Bank.

I've linked this site to my complaint place at www.bankfees.info
