WEST MEMPHIS THREE

Having come accessed this site from google for something else, i read with incredible disbelief the injustice i feel has been done in this story.  You just have to ask yourself because of rumour these "supposed satanic killers" are now rotting in jails, for a crime which I'm sure they did not commit.  Why did no one reveal anything about the man in the truck stop, who i'm sure had a large part in this sickening crime.

Has there been any new updates since july 2004?

Hey,I'm Anna welcome to the Junction.I did a story about this case and I'm pretty sure it is stii up...was that the article you read?

There has been another book about the case by Myra Levertt called "Devils Knot"and if you are interested we can dicuss that here.I believe the wrong people in jail and I fear that the real killer might act out and re-once again offend and not be caught.

Thanks for replying, it was such a shocking story. I have not read the new book, I live in Scotland and just came across the website looking for something else, but I would be happy to discuss it any time.

Have there been any updates on this case lately?

Tests show victims' DNA; no WM3 link

By LAURA SMITH
aurahoughsmith@gmail.com
Results of DNA testing of crime scene evidence in the 1993 slayings of three 8-year-old West Memphis boys showed no connection to the three local teenagers convicted in the killings, and nearly all the recovered material tested belonged to that of the victims, according to reports filed Thursday with the Arkansas Supreme Court.

A report filed by Second Judicial District Prosecutor Brent Davis states that the only material that doesn't belong to the victims - Michael Moore, Christopher Byers and Stevie Branch - is a hair found on a victim's shoelace that likely belongs to the step-father of one of the victims.

News of the hair evidence was first reported in the Arkansas Times by investigative journalist and author of The Devil's Knot: The True Story of the West Memphis Three Mara Leveritt, who reported that Terry Hobbs was told a piece of his hair was in the knots that tied up [victim] Michael Moore.

At the time of the murders, Hobbs was married to the mother of Stevie Branch, whose bound body found was in the 10-Mile Bayou diversion ditch along with the bodies of his two friends, also bound.

West Memphis Assistant Police Chief Mike Allen, who was an investigator at the time of the killings, attributed the finding of Hobbs' hair to transfer evidence and said Hobbs is not a suspect.

If you test my clothes, you're going to find trace DNA evidence from my wife, my son, my black Lab and my brown Lab, Allen said. In 1993, Terry Hobbs wasn't a suspect, and he's not a suspect in 2007.

Allen said police have recently questioned Hobbs.

Because things sometimes come up, we have to check and double-check our facts, and he is not a suspect, Allen said. We're all professionals here, and we plan on doing the right thing.

The questioning of Hobbs also goes along with the state's authorization to police investigators to conduct follow-up interviews with witnesses.

Damien Echols, Jason Baldwin and Jessie Misskelley Jr. were convicted of the murders in 1994, who were 18, 16 and 17, at the time of their arrests. Echols, now 32, was sentenced to receive the death penalty; Misskelley, now 30, received a life sentence plus 40 years; and Baldwin, 32, was sentenced to life without parole.

Attorneys for Echols and prosecutors have agreed to further testing of some items of evidence.

However, the prosecutors disagreed with the defense attorney's statement that both sides came to that agreement due to the items' potential significance to establishing the identity of the perpetrators of the offense.

In their responding report, prosecutors said they disagree with that characterization.

The State stands behind its convictions of Echols and his codefendants as the perpetrators...The state anticipates that it will defend its judgements successfully at any hearing in circuit court.

Echols' attorney, San Francisco attorney Dennis Riordan, declined comment, and Davis referred comments to his response.

However, news of the results sparked hope among those who have supported further investigation into the crime.

This case has cried out for reexamination from the start. The attention it's getting now is important, and I hope it will be effective, Leveritt said. My hope is that there will be sufficient reason for the state of Arkansas to bring this back to court for a proper review.

It has long been my belief,as many others, that the wrong people are in prison for this crime.I am not accusing Terry Hobbs,or anyone else but I can't for the life of me figure out why the hell, with the tecnology and police we have, can we not get this thing figured out? The reality of it is,you can't commit a triple homicide and leave behind absolutely no forensic evidence at all.   evileye

Please read "Almost Home" written by Damian...it is really informative. These poor boys are soooo innocent. Even the man in my life who is extremely scepticle (sp) is the one who introduced me to this case saying that he could not believe they were found guilty. Since then I have read everything I could lay my hands on and if nothing else....there is nothing showing their guilt.

yes, I have both of them however the 2nd one was bit out there for my taste. Paradise Lost was the one my honey saw that led him to tell me about it. I had heard of the case but wasn't really that informed on it. I guess I thought I had enough cases going on in my head at the time.

Celebrities join rally to free Ark. men convicted in 1993 slayings of three boys

LITTLE ROCK, Ark. (AP) An effort to free three young men convicted in the lurid 1993 slayings of three 8-year-old boys is gathering speed, with rock stars and other celebrities taking up their cause and about 150 supporters rallying Wednesday on the steps of the Arkansas Capitol.

Supporters of the "West Memphis Three" say prosecutors and a small-town police force railroaded the young men because of their fascination with heavy metal music and the occult. And they say new DNA tests and other forensic evidence call their guilt into question.

At the Capitol, sympathizers including Natalie Maines, lead singer for the Dixie Chicks, unfurled a long banner of postcards asking for the men to be released.

"You want to do anything you can to right this wrong," said Maines, whose earlier criticisms of President Bush outraged many country music listeners. "I'm just amazed that these guys are still in prison and have turned into men in prison."

For years, prosecutors have steadfastly maintained the defendants committed the crime. And the convictions have withstood numerous appeals, with the Arkansas Supreme Court saying in 1996 that there was "substantial evidence" of guilt.

The grisly killings of Stevie Branch, Christopher Byers and Michael Moore shocked West Memphis, a blue-collar town of about 28,000 across the Mississippi River from bustling Memphis, Tenn.

Police found the battered bodies of the three Cub Scouts in a drainage ditch a day after they disappeared from their neighborhood. Their hands were bound to their legs with shoelaces, and one boy was sexually mutilated, prosecutors say.

Three teenagers -- Jason Baldwin, Damien Echols and Jessie Misskelley -- were arrested a month later, largely on Misskelley's confession. Misskelley told investigators how he watched Baldwin and Echols sexually assault and beat two of the boys as he chased down another who was trying to escape.

The case -- two trials, held in 1994 -- included testimony and prosecutors' allegations that the defendants acted as part of a satanic cult, and that they used to eat the hind legs of dogs and participate in orgies.

A jury gave Misskelley life in prison plus 40 years. Baldwin got life without parole. Echols, then 19, the oldest of the three, was sentenced to die. No execution date has been set.

A 1996 HBO documentary, "Paradise Lost: The Child Murders at Robin Hood Hills," galvanized many supporters, who say that it reinforced their belief that the defendants were falsely convicted because they listened to heavy metal music and dressed in black in a small Southern town with a strong Christian faith.

"They were listening to Metallica. They were listening to the music they liked," said supporter Kody Bradshaw, 19, of Gurdon. "I feel blessed to be an avid, open supporter in my town. We live smack in the middle of the Bible Belt."

Since the film's release, Echols' art made from old magazines and prison-issued razors has sold at auction, the proceeds going toward a defense fund. Echols contributed lyrics to rock band Pearl Jam's 2006 album. Henry Rollins, frontman for punk rock band Black Flag, issued a tribute album in 2002 to raise money for their defense. Comedian Margaret Cho highlighted the case several times on her blog, posting a picture of herself across from a bespectacled Echols, sitting behind prison glass.

"Damien is beautiful like a girl, with a pale, delicate complexion that is Dove Cleansing Bar-worthy," Cho wrote after a 2004 visit. "He is an inspiring teacher and a remarkable thinker. His writing is a constant source of wonder, especially as he lives in this terrible captivity."

In all, the defense fund has received more than $1 million over the past decade from celebrities and Internet donors, money that has gone toward new DNA testing and a second federal appeal on Echols' behalf, said supporter Capi Peck.

The new appeal, filed in October, includes the results of DNA tests conducted by a private laboratory in Virginia. The lab said much of the evidence failed to yield reportable results, but on the material that could be tested, no traces of the three defendants were found.

The filing also included claims by forensic experts that the bodies were not mutilated by the killers, but mauled by animals.

A federal judge ordered the state courts to examine the new claims first. The Arkansas attorney general has asked for more time to look over the material. However, a spokesman said the state stands behind the convictions.

Asked Tuesday if he would consider commuting or pardoning the three, Democratic Gov. Mike Beebe said: "No, absolutely not."

The Arkansas Supreme Court in 1996 roundly rejected an appeal from Echols and Baldwin, who were tried jointly. It also upheld the judge's decision to let the jury see evidence such as a funeral register Echols owned, as well as a journal that contained "morbid images and references to dead children."

Defense lawyers claimed detectives coerced two taped statements out of the then-17-year-old Misskelley, who they say had the mental capacity of a child. Supporters of the three point to inconsistencies -- how Misskelley offered the wrong times for the slayings and the wrong colors for the shoelaces that bound the second-graders.

But the Arkansas high court noted that Misskelley was advised of his rights three times during a four-hour interview with officers. The court also noted Misskelley's "detailed knowledge of the injuries inflicted on the boys."

The U.S. Supreme Court declined to hear a 1997 appeal from Echols.

What is clear from the record is Echols' macabre imagination.

"I kind of enjoy it because now even after I die, people are going to remember me forever. They're going to talk about me for years," he told the documentary filmmakers.

"People in West Memphis will tell their kids stories. It will be like, sort of like I'm the West Memphis boogeyman. Little kids will be looking under their beds before they go to bed."

Hi Everyone,
In this month's People magazine [Britney Spears is on the cover] there is an article by Johnny Dodd about the West Memphis Three.
I couldn't believe it when I came to the part where John Mark Byers, who was so unbelievably vindictive said that he was now convinced that Damian,Jessie, and Jason are INNOCENT! He said he "needed someone to hate." And even though there has never been any DNA,and he knew that,he chose to hate them.

Frankly,it makes me wonder what Melissa Byers was thinking.

In the magazine there is a photo of Byers and he looks completely different.I have to say,I never trusted him and I wonder what his motives are now.The man needs psyciatric help.Watch the documenteries,"Paradise Lost:The Child Murders At Robin Hood Hills" and its sequel.Byers looks very odd.I know the man had been through a lot but.....call me sceptical.

I'm thrilled to see a mainstream magazine like People giving this attention. We can't let this go away. Free the WM3!    evileye

Benefit aims to make money to free imprisoned 'West Memphis Three'

By: Karla Hernandez

Issue date: 3/5/08 Section: Entertainment
Four Chico bands are following the lead of The Cure, Henry Rollins and Margaret Cho by raising money to free three imprisoned men caught in a 15-year-old murder case associated with a satanic ritual.

The Shankers, V.E., Baghdad Batteries and Season of the Witch will be playing a benefit concert Sunday at Lost on Main as part of an international concert series called Rock for Freedom Weekend. Shows in the United States, Canada and Australia will raise money for the defense fund of the three men, who many think were falsely convicted.

Beth Davis is organizing the Chico show to inform people about the murder case and help the three men prove their innocence, she said.

"It's one common goal to set the record straight," Davis said.

Damien Echols, Jason Baldwin and Jessie Misskelley, known as the West Memphis Three, were accused of murdering three 8-year-old boys in 1993 in West Memphis, Ark.

The men were thought to have been part of a satanic ritual after the victims were found in a creek with their ankles tied to their wrists, according to wm3.org, a Web site supporting the men.

The case has received massive attention from the media and individuals because of the lack of evidence against the three men. Musicians have raised money by auctioning autographed instruments and producing compilation albums. There are also documentaries and books about the case.

At the time of the murders, Echols, Baldwin and Misskelley were teenagers and had no connection to the victims, according to wm3.org. DNA belonging to the three men was not found at the murder site.

Misskelley confessed to the murders after 12 hours of police interrogations, according to wm3.org. He later retracted his statements after reporting investigators pushed him into a false confession. Misskelley was reported as having an IQ of 72, classifying him as borderline mentally retarded.

In an interview with Larry King, Echols said that personal traits such as clothing and musical tastes were also major factors used against the three men. The men wore black clothing and listened to Metallica.

Baldwin and Misskelley were given life sentences, while Echols was sentenced to death by lethal injection, according to wm3.org. Echols' execution date has not been determined.

"It's pretty much a modern-day witch trial," Davis said.

The Baghdad Batteries agreed to play the benefit show because band members think it was wrong that the case involved profiling, said vocalist Justin McBurey.

"I can relate with being different," he said.

The Shankers were compelled by the case after watching one of the documentaries, said bassist Kerra Shanker.

Shankers vocalist Johnny Shanker does not agree with the evidence used against the West Memphis Three, he said.

"They were guilty before they were accused," he said.

The Arkansas media bought into the stereotypes of troubled teens, Davis said.

Early stories helped portray Echols, Baldwin and Misskelley in a negative light, she said.

"Being in a small town, that's what happens," she said.

The time of the murders also had a lot to do with the stereotypes of the three men, Johnny Shanker said. In a small town, it was rare for people to have mohawk haircuts and listen to Metallica in the early '90s.

Even though the case is 15 years old, the Internet has helped spread the word about the case in the last few years, Davis said. People are seeing that the three men were really not strange for wearing black clothing. People can also research the case before jumping to conclusions.

"On the Internet, it's not bias," she said. "You get both sides."

In the last year, parents of two of the victims have told the media they think the West Memphis Three are innocent.

Davis thinks the statements will help the case, she said.

"Maybe more people will say 'Maybe we were wrong. Let's take another look,'" Davis said.

McBurey thinks it will take more than statements from the victims' parents for the West Memphis Three to get freedom, he said. A lot of politics are involved with the case, and it is harder when the three men have already been convicted.

The money raised from all the Rock for Freedom Weekend shows will pay for DNA testing and future hearings, Davis said.

Defense lawyers requested a new hearing in October to show that no DNA from any of the convicted men was present at the murder site. A hearing date has not been announced.

Whether the West Memphis Three are innocent or guilty, McBurey thinks they deserve closure, he said.

"I just want it all to be over."

I edited this down a little,I want to keep it mostly links to information and news about the case. There are a wealth of back articles and I'm looking to post some of them even if they are older. They may have information someone reading about this for the first time has never heard.

There will be plenty of room in the other WM3 thread for case discussion. Take it there.

This is very recent,September 9,2009 from the Arkansas Times. Written by Mara Leveritt, author of the book,Devils Knot about the case of the WM3. Please read this.It breaks down a very simple fact about what is availible to us under the freedom of information act,and what can happen when that act is violated.

Morning Y'all!  biggrin

This thread will be primarily for links and news items about the case. The amount of misinformation is staggering, and I can easily see why people quickly turned a blind eye to the truth and overcome by fear, ignorance and media propaganda chose to believe the myth instead of the reality.

I watched Paradise Lost this evening not realizing I had already seen it some time back.  It is amazing that three kids can be hijacked by the justice system the way these guys were.  If my child had been murdered the way the little boys were murdered, I would be out of my mind with grief and hate, but even then, I believe I'd have to admit that there was just no evidence to convict the teenagers.  They've now spent more than half their lives in prison for something they didn't do.  It is not just a waste but it is also terrifying.  If that could happen to those boys, it could happen to any of us.

The first time I saw Paradise Lost,a friend brought it over and we sat on the couch to watch it.

By the end of the movie,we were sitting on the floor,I was chewing my nail.We sat there, getting closer and closer to the TV,as if that would somehow explain how this happened.

We all think we're so safe. I'm going out on my WM3 rant, here. We're not safe. The system is broken. The evidence in this case was circumstancial, the confession coerced. Why wasn't it further investegated? And please don't tell me there wasn't anything to investigate.

Again,I recomend the book Devil's Knot by Mara Leveritt to get a clear picture of the crime and trials. Stuck is right,it can happen to any of us.        evileye

There are several very famous actors and musicians who have publicly said they believe the West Memphis Three are innocent. Someone forwarded me this link and I thought you'd like to see who it is because....well,because I love him, damn it!    biggrin

I'm kidding, sort of. The more attention we can give this cause, the better. If you are just reading this for the first time, you can pick any link to know the facts of the case, but the best by far is www.wm3.org

It's been said that I've given this case special attention, with our t-shirt project and what we've done.Maybe I have. But if an innocent man sits in prison for a murder he didn't commit, how fair is that to the person murdered?

And look at this link to see the star adding his name to the list of supporters. Pretty freakin sweet!     evileye

Morning friends,

Today is the 48 Hours special about the WM3 and I wanted to ask each and every one of you to please take the time to watch it if you can. We all need to be as informed as possible so when the situation occurs that someone asks about the case, the facts will be at hand.

In addition, the legal team has posted a video about the defense fund at their website. If there is any amount you can give,it may make the difference. Unfortunately this has become an expensive defense and I ask you to please join me in supporting this most worthwhile cause.

As always, details are at www.wm3.org   evileye
